Skilled nursing facilities, assisted living communities, and home health agencies are adopting AI tools faster than almost anyone in healthcare. They are also, by a wide margin, the least equipped to manage the compliance implications. This is not a hypothetical risk. It is happening right now, and the gap between AI usage and compliance infrastructure in long-term care is genuinely alarming.
The Budget Reality
The average skilled nursing facility operates on margins between 1% and 3%. Medicaid reimbursement rates, which fund roughly 62% of nursing home residents nationally, have not kept pace with inflation in most states. A 2023 report from the American Health Care Association found that 67% of nursing homes were operating at a loss. Home health agencies are in a similar bind; CMS finalized a 5.653% cut to the home health payment rate for 2024 before partially walking it back after industry pushback.
Against this backdrop, compliance departments in long-term care are skeletal. Many facilities with 100+ beds have a single compliance officer who also handles quality assurance, infection control reporting, and sometimes HR. Dedicated privacy officers under HIPAA are rare. The compliance budget at a typical mid-size SNF might be $50,000 to $80,000 annually, covering training, audits, and whatever software they can afford. Compare that to a mid-size hospital system spending seven figures on compliance infrastructure.
So when these facilities start using AI, and they are, the compliance scaffolding simply does not exist.
Where AI Is Showing Up
The adoption patterns in long-term care are different from acute care. You are not seeing surgical robotics or AI-assisted radiology reads. Instead, the tools are more operational and administrative:
- Predictive analytics for fall risk and readmission risk, often bundled into EHR platforms like PointClickCare or MatrixCare
- AI-powered scheduling and staffing optimization, which ingest patient acuity data to predict labor needs
- Automated clinical documentation, including ambient listening tools that generate nursing notes from verbal patient interactions
- Chatbots and virtual assistants for family communication portals and intake processes

Every single one of these touches protected health information. Several of them involve automated decision-making that directly affects patient care. And most of them are being procured by operations teams or IT directors without meaningful compliance review.
The HIPAA Exposure
The core HIPAA problem is straightforward: many of these AI tools involve business associates who are processing PHI, and the Business Associate Agreements either do not exist, are boilerplate templates that do not address AI-specific risks, or were signed years ago before the facility started feeding patient data into machine learning models.
HHS OCR has been clear about this. The December 2022 bulletin on tracking technologies and HIPAA was a shot across the bow, and while it focused on web tracking pixels, the underlying principle applies to any technology that transmits PHI to a third party. If your AI vendor is receiving PHI to train or operate its models, you need a BAA that specifically addresses data use, model training, de-identification standards, and breach notification timelines.
The HIPAA Security Rule's risk analysis requirement (45 CFR 164.308(a)(1)) demands that covered entities assess risks to ePHI across all systems. An AI tool processing nursing notes or patient vitals is a system. If it is not in your risk analysis, you are out of compliance. Period. OCR's enforcement record shows they take this seriously; the $1.25 million settlement with Banner Health in 2023 centered partly on inadequate risk analysis covering systems that handled PHI.
For ambient documentation tools specifically, the Privacy Rule's minimum necessary standard (45 CFR 164.502(b)) creates a real problem. These tools often capture entire conversations, including information that is not clinically relevant. If that data is transmitted to a cloud-based AI for processing, you have a minimum necessary violation unless you have implemented controls to limit what gets sent.
The CMS Angle
CMS adds a separate layer of risk that gets less attention. Skilled nursing facilities certified for Medicare and Medicaid participation must comply with the Requirements of Participation at 42 CFR Part 483. Several of these intersect directly with AI use:
- 42 CFR 483.21 requires comprehensive, person-centered care planning. If an AI tool is influencing care decisions (staffing levels, fall interventions, medication management), surveyors can and will ask how those recommendations are validated and incorporated into the care plan.
- 42 CFR 483.12 covers resident rights, including the right to be informed about care and treatment. If algorithmic triage in home health determines that a patient's alert does not warrant a nurse visit, the patient has a right to understand that process.
- 42 CFR 483.70(d) requires facilities to maintain effective information systems. CMS surveyors are increasingly looking at how data flows between systems, and an AI tool that introduces errors into the medical record creates a compliance finding.
The enforcement mechanism here is the survey process. State survey agencies conduct inspections on behalf of CMS, and deficiency citations can lead to civil monetary penalties, denial of payment for new admissions, or termination from Medicare/Medicaid. In 2023, CMS imposed over $89 million in civil monetary penalties on long-term care facilities. Adding AI-related deficiencies to the survey process is not a matter of if; it is a matter of when.
What Facilities Should Actually Do
Given the budget constraints, the answer cannot be "hire a team of AI compliance specialists." It has to be practical.
First, inventory every AI tool in use. This sounds basic, but most facilities cannot produce this list today. Include anything with predictive, automated, or machine learning capabilities, even if the vendor markets it as "smart" software rather than AI. Map each tool to the PHI it accesses and the decisions it influences.
Second, update your BAAs. If your agreement with an AI vendor does not address model training on your data, data retention after the contract ends, sub-processor use, and de-identification methodology, it is inadequate. HHS has not issued AI-specific BAA guidance yet, but the existing requirements under 45 CFR 164.504(e) give you the framework.
Third, incorporate AI tools into your HIPAA risk analysis. This is non-negotiable and already required. Document the risks, the mitigations, and the residual risk you are accepting. If a tool fails your risk analysis, stop using it until the vendor addresses the gaps.
Fourth, prepare for survey questions about AI. Train your clinical leadership to explain how AI-generated recommendations are reviewed by qualified staff before affecting care plans. Document the human oversight process. CMS surveyors follow the Interpretive Guidelines, and while those guidelines have not been updated for AI yet, the underlying standards around clinical decision-making and resident rights already apply.
