Hospital marketing teams are under real pressure to produce content. Patient testimonials, success stories, social media posts, blog articles, video scripts. The volume expectations have gone up dramatically in the last few years, and AI tools have become the obvious way to keep pace. The problem is that healthcare marketing sits directly on top of one of the most sensitive data categories in American law, and the speed that makes AI useful is the same speed that makes it dangerous here.

I keep seeing the same pattern. A marketing coordinator drops patient information into ChatGPT or a similar tool to draft a testimonial, polish a case study, or generate social copy. Sometimes they have a signed authorization. Sometimes they think they do. Sometimes they just figure the patient already agreed to be in a video, so using their story in other formats is fine. None of these assumptions hold up under HIPAA, and the enforcement record makes that clear.

Where the Line Actually Is

HIPAA's Privacy Rule, specifically 45 CFR 164.508, requires a valid written authorization before a covered entity can use or disclose protected health information for marketing purposes. The authorization has to be specific. It needs to describe the PHI to be used, who will use it, the purpose, an expiration date, and the individual's right to revoke. A general consent form signed at intake does not count. A verbal "sure, you can share my story" does not count. Even a signed media release may not satisfy the HIPAA authorization requirements if it lacks the required elements.

The 2013 Omnibus Rule tightened the definition of marketing under HIPAA. Any communication about a product or service that encourages the recipient to purchase or use it is marketing, with narrow exceptions for treatment communications and health-related communications where the covered entity receives no payment. Hospital marketing departments are almost always operating in the zone that requires authorization.

And here is where AI makes things worse. When a marketing team member pastes patient details into a third-party AI tool, that is potentially a disclosure of PHI to a non-covered entity. Unless the AI vendor has signed a Business Associate Agreement under 45 CFR 164.502(e), that disclosure is a HIPAA violation on its own, completely independent of whether the patient authorized the marketing use.

The BAA Problem With Consumer AI Tools

OpenAI, Google, Meta, Anthropic. None of their consumer-tier AI products come with BAAs. Some enterprise tiers offer them, but the marketing coordinator using the free version of ChatGPT to rewrite a patient story is not on an enterprise tier. The moment PHI enters that tool, it has been disclosed to a third party without a BAA. OCR does not need to find that the information was further misused. The unauthorized disclosure itself is the violation.

This is not hypothetical. In July 2020, OCR settled with Lifespan Health System for $1,040,000 after an unencrypted laptop containing PHI was stolen. The core issue was insufficient safeguards for PHI that left the covered entity's control. The principle scales directly to cloud-based AI tools. If PHI leaves your environment and enters a system you do not control under a BAA, you have a problem.

The Three Scenarios That Keep Happening

1. The AI-Polished Testimonial

A patient agrees to provide a testimonial. Marketing has a signed authorization, maybe even a proper one. But the team wants to clean up the language, so they paste the testimonial into an AI writing tool along with the patient's name, condition, treatment details, and outcome. The AI tool now has PHI. The authorization the patient signed covered the hospital's use of their story in marketing materials. It did not authorize disclosure to an AI vendor. Two separate HIPAA provisions are in play: the marketing authorization requirement and the BAA requirement for disclosures to business associates.

2. The De-Identified Case Study That Is Not Actually De-Identified

Marketing wants to write a case study. Someone pulls together the clinical narrative, changes the patient's name, and feeds it into an AI tool to generate a polished version. They believe this is de-identified data and therefore outside HIPAA's scope. But HIPAA's de-identification standard under 45 CFR 164.514 is rigorous. The Safe Harbor method requires removal of 18 specific identifiers, and the covered entity must have no actual knowledge that the remaining information could identify the individual. A 62-year-old female who received a specific rare procedure at your facility in March 2024 is likely re-identifiable, even without a name. Feeding that into an AI tool is still a potential PHI disclosure.

3. Social Media Content Generation

This one is increasingly common. Marketing teams use AI to generate social media posts about patient success stories, community health events, or service line promotions. Sometimes the prompts include real patient details as context, even if the final output is generic. The prompt itself is the problem. If PHI is in the input, it has been disclosed to the AI vendor regardless of what the output looks like. OCR's guidance on social media, published in December 2022, explicitly warned covered entities about sharing PHI on social platforms and through related tools.

What OCR Has Actually Done

OCR has been active in this space, though most enforcement actions to date involve adjacent issues rather than AI specifically. The agency settled with New York Presbyterian Hospital for $4.8 million in 2016 after PHI was disclosed during a film crew's recording in the hospital. The lesson was clear: marketing activities involving patient information face strict scrutiny.

More recently, OCR's December 2022 bulletin on tracking technologies addressed the use of tools like Meta Pixel and Google Analytics on hospital websites, finding that IP addresses combined with health information constituted PHI. Several class action lawsuits followed, including Doe v. Advocate Aurora Health, filed in the Northern District of Illinois. The tracking technology guidance signals exactly how OCR will approach AI tools that ingest PHI: if the technology receives identifiable health information without a BAA, you are exposed.

In February 2024, OCR announced a settlement with Montefiore Medical Center for $4.75 million related to insider threats and insufficient access controls. While not a marketing case, it reinforces that OCR expects covered entities to control where PHI goes, including when employees are the ones moving it.

Practical Steps That Actually Help

  • Treat every AI tool as a potential business associate. If PHI could enter the tool, you need a BAA or you need to keep PHI out of it entirely.
  • Train marketing staff specifically on what constitutes PHI. Most marketing professionals have not read 45 CFR 164.514. They need concrete examples, not just a policy document.
  • Separate the authorization for marketing use from the authorization for AI processing. These are distinct disclosures with distinct recipients.
  • Implement technical controls. Do not rely on policy alone. If your AI tools cannot receive PHI, configure them so PHI cannot reach them. Network-level controls, DLP tools, and approved-tool-only policies all help.
  • Audit AI tool usage in marketing departments quarterly. Shadow AI adoption is real. Marketing teams adopt tools fast and ask permission later.
