Payers are under real pressure to speed up claims adjudication. The math is straightforward: the average cost to manually process a single claim runs between $3.50 and $5.00, and large payers handle millions per month. AI models that can auto-adjudicate clean claims, flag anomalies, and route complex cases to human reviewers can cut that cost by 50% or more. Anthem (now Elevance Health) reported in 2023 that its AI-driven claims processing reduced turnaround times by roughly 30%. The incentive structure is obvious.

The problem is also obvious. Claims data is PHI. Every claim contains member identifiers, diagnosis codes, treatment histories, provider information, and payment details. All of it falls squarely under the HIPAA Privacy Rule (45 CFR Part 160 and Subparts A and E of Part 164). And the Security Rule (Subparts A and C of Part 164) governs how you store, transmit, and process it electronically. Getting the AI benefits while staying compliant requires deliberate architectural choices, not just a BAA and a prayer.

The Regulatory Landscape You Are Working Within

Let's be specific about what applies here. When a covered entity (the payer) uses AI for claims adjudication, the activity falls under "payment" operations as defined in 45 CFR 164.501. This means you do have a valid basis for using PHI without individual authorization. You can process claims data for payment purposes. The question is how, not whether.

The Minimum Necessary Standard (45 CFR 164.502(b)) is where most AI implementations get sloppy. The rule requires that you use, disclose, or request only the minimum PHI necessary to accomplish the intended purpose. If your AI model is ingesting full medical records to adjudicate a dental claim, you have a problem. The model's input scope needs to be scoped to the claim type.

Then there is the Security Rule's requirement for technical safeguards: access controls (164.312(a)), audit controls (164.312(b)), integrity controls (164.312(c)), and transmission security (164.312(e)). These are not suggestions. OCR's enforcement record makes that clear. In 2023 alone, OCR collected over $4.1 million in HIPAA penalties, and several involved inadequate technical safeguards around electronic PHI.

Business Associate Agreements Are Necessary but Not Sufficient

If you are using a third-party AI vendor for claims adjudication, yes, you need a BAA under 45 CFR 164.502(e). But a signed BAA does not make your architecture compliant. The 2024 OCR guidance on tracking technologies made this painfully clear: covered entities remain responsible for ensuring that PHI shared with business associates is handled appropriately, regardless of what the contract says. If your vendor's model training pipeline inadvertently retains PHI in model weights or log files, the BAA does not insulate you from liability.

Architectural Decisions That Actually Matter

1. Data Minimization at Ingestion

Build your pipeline so the AI model receives only the fields it needs for the specific adjudication task. A prior authorization review for a surgical procedure needs the procedure code, diagnosis codes, member eligibility status, and relevant clinical criteria. It does not need the member's full claims history going back five years. Implement field-level filtering before data hits the model. This is your Minimum Necessary compliance in practice.

2. De-identification vs. Pseudonymization

HIPAA's Safe Harbor method (45 CFR 164.514(b)(2)) lists 18 identifier types that must be removed for data to be considered de-identified. For model training, full de-identification is the gold standard. But for real-time adjudication, you need to link the output back to a specific claim and member. Pseudonymization with tokenized identifiers lets you do this. The model processes tokens instead of raw member IDs, and a separate, access-controlled mapping service re-identifies the output. Keep the mapping service in a different security zone with its own audit trail.

3. Compute Environment Isolation

Run your AI inference in an environment that is logically and, ideally, physically separated from general-purpose infrastructure. This is not just good practice; it directly supports the Security Rule's access control requirements. Use dedicated VPCs or private cloud tenancies. No shared compute with non-HIPAA workloads. Encryption at rest (AES-256 is the current standard) and in transit (TLS 1.2 minimum, though 1.3 is preferable). These are table stakes, but I still see implementations where the claims AI runs in the same environment as the marketing analytics platform.

4. Audit Logging That Is Actually Useful

The Security Rule requires audit controls, but the regulation does not prescribe a specific format. For AI-driven adjudication, your logs need to capture what data the model accessed, when, what decision it produced, and what confidence score it assigned. This matters for two reasons. First, OCR investigations will ask for it. Second, state regulators are increasingly interested in AI-driven claims denials. The 2024 amendments to California's SB 1120 and similar legislation in other states require payers to disclose when AI was used in coverage determinations. If you cannot produce a clear audit trail showing what the model saw and why it decided what it decided, you are exposed on both the HIPAA and state regulatory fronts.

5. Human-in-the-Loop for Adverse Determinations

This is partly a HIPAA concern and partly a broader regulatory one. CMS issued guidance in February 2024 reinforcing that Medicare Advantage organizations cannot use AI or algorithms to deny coverage without physician review of the individual case. Several class action lawsuits, including Benyamin v. UnitedHealth Group (filed November 2023 in the District of Minnesota), allege that AI-driven claims denials violated ERISA and state insurance regulations. The architectural implication: your system must route denials and adverse determinations to qualified human reviewers before they are finalized. Build this into the workflow, not as an afterthought.

6. Model Training on PHI Requires Extra Care

If you are training or fine-tuning models on claims data, the PHI exposure surface expands significantly. Training data can be memorized by models, a phenomenon well-documented in machine learning research (Carlini et al., 2021, demonstrated extraction of training data from GPT-2). Use de-identified data for training wherever possible. If you must use PHI, implement differential privacy techniques and ensure that trained model weights are treated as potentially containing PHI for purposes of access controls and retention policies. This is an area where OCR has not yet issued specific guidance, but the general Security Rule obligations clearly apply.

The State Layer

Do not forget that HIPAA sets a floor, not a ceiling. States are actively legislating AI in insurance. Colorado's SB 21-169 requires insurers to test AI systems for unfair discrimination. Illinois and Connecticut have similar measures in progress. Your architecture needs to support not just HIPAA compliance but also the ability to demonstrate fairness testing and produce explanations for AI-driven decisions. Build the instrumentation now. Retrofitting explainability into a production claims adjudication system is expensive and disruptive.
