Defense Cyber Incident Reporting and the AI Tool Discovery Problem

DFARS 252.204-7012 gives you 72 hours. From the moment you discover a cyber incident affecting covered defense information, the clock starts. You need to report to the DoD via the DIBNet portal, preserve images of affected systems for at least 90 days, and provide enough detail for the DC3 (Defense Cyber Crime Center) to assess damage. Seventy-two hours is tight under the best circumstances. Now add a variable that the original rule drafters never anticipated: undocumented AI tools running inside your environment.

What the 72-Hour Clock Actually Demands

The reporting requirement under DFARS 252.204-7012(c) is more granular than people sometimes remember. You are not just flagging that something happened. The contracting officer and DC3 expect specific deliverables: a description of the technique or method used, a sample of malicious software if available, a summary of the covered defense information potentially compromised, and identification of the affected covered contractor information systems. You also need to provide "any other information not previously provided" as it becomes available.

This means your incident response team needs to rapidly trace the attack surface, understand data flows, and determine what was exposed. The forensic work is substantial. In a well-documented environment, it is already a sprint. In an environment where employees have been quietly feeding data into AI tools that IT never provisioned, it becomes something closer to archaeology.

The Shadow AI Problem in Defense Contracting

Shadow IT is not a new concept. But shadow AI has a different risk profile. Traditional shadow IT, like an unapproved SaaS app for project management, creates a data exposure surface that is relatively static. An unapproved AI tool creates a dynamic surface. Data goes in, gets processed, may be stored for model training, may be cached, may be retrievable through prompt injection by other users of the same service. The data flow is opaque even to the people using the tool.

A 2024 survey by Salesforce found that more than half of generative AI users at work were using unapproved tools. In defense contracting environments subject to NIST SP 800-171 controls, that number should theoretically be zero. In practice, the gap between policy and behavior is real. An engineer pastes a technical specification into ChatGPT to help draft documentation. A program manager uploads a spreadsheet to an AI-powered analytics tool to build a presentation. A subcontractor's employee uses Copilot features that were enabled by default in a Microsoft 365 tenant nobody audited.

None of these tools appear in your system security plan. None of them are in your asset inventory. None of them are covered by your incident response procedures.

Why This Breaks Incident Response

When a cyber incident occurs, your IR team follows the playbook. They identify affected systems, trace data flows, contain the breach, and start building the report for DC3. Every step of that process depends on knowing what systems exist and what data they touched.

Undocumented AI tools blow holes in that process at multiple points:

  • Asset identification fails. If a tool is not in your inventory, you cannot assess whether it was involved in the incident. You may not even know to look. An attacker who compromised credentials could have accessed an AI tool that cached covered defense information, and your team would have no visibility into it.
  • Data flow analysis is incomplete. DFARS 7012 requires you to identify what CDI was potentially compromised. If data was sent to an AI service that your organization does not control, you cannot determine what was stored, for how long, or who else might have accessed it. The third-party AI provider's terms of service and data retention policies become relevant, and you probably have not reviewed them because you did not know the tool was in use.
  • Forensic imaging is impossible or incomplete. The 90-day image preservation requirement under 7012(e) assumes you can actually capture the state of affected systems. For a cloud AI tool with no enterprise contract, you likely have no ability to request logs, no API access, and no legal leverage to compel preservation.
  • The 72-hour window compresses further. Time spent discovering that undocumented tools exist is time not spent on the actual investigation. If your team spends 18 hours just figuring out that an employee was using an unapproved AI transcription service that processed recordings of classified program meetings, you have burned a quarter of your reporting window on discovery alone.

The Compliance Cascade

The downstream effects get worse. DFARS 252.204-7012 does not exist in isolation. It connects to NIST SP 800-171, which requires a complete and accurate system security plan (control 3.12.4) and restricts the use of information systems to authorized purposes (control 3.1.1). Undocumented AI tools represent a failure of both controls simultaneously.

If a cyber incident investigation reveals that your SSP was materially inaccurate because it did not account for AI tools processing CDI, you now have a compliance problem layered on top of a security problem. Under the False Claims Act, the DOJ has been increasingly aggressive about pursuing contractors whose cybersecurity self-assessments do not match reality. The DOJ's Civil Cyber-Fraud Initiative, launched in October 2021, has already produced settlements in the millions. In 2022, Aerojet Rocketdyne settled a False Claims Act case for $9 million related to alleged misrepresentation of its cybersecurity compliance. The case involved, among other things, gaps between the company's stated security posture and its actual practices.

Now consider how a CMMC assessor would view an environment where AI tools were processing CDI outside the assessment boundary. Your CMMC Level 2 certification, which is tied to NIST SP 800-171 compliance, could be directly at risk. The final CMMC rule published in October 2024 (32 CFR Part 170) makes this a contractual requirement with real teeth.

What Actually Helps

The practical solution is not banning AI tools. That approach has a poor track record, and it pushes usage further underground. The solution is making AI tool usage visible, governed, and included in your incident response scope.

This means maintaining a real-time inventory of AI tools in use across the organization, including at the subcontractor level. It means having data flow maps that account for AI processing. It means your incident response plan explicitly addresses scenarios involving AI tools, with pre-negotiated log access and data retention commitments from approved providers. And it means continuous monitoring, not annual assessments, because the AI tool landscape changes weekly.
